Current legislation demands that employers ensure portable appliances are safe. However there is no such legal statement that states you must PAT test. What legislation does state is shown in relevant information below.
The Health & Safety at Work etc Act 1974 (HSWA)
Regulation4(2)
- As may be necessary to prevent danger all systems* shall be maintained so as to prevent so far as is reasonably practicable such danger.
* "system" an electrical system in which all the electrical equipment is, or maybe, electrically connected to a common source of electrical energy and includes the source and such equipment.
"Electrical equipment" includes anything used, intended to be used or installed for the use, to generate, provide, transmit, rectify, convert, conduct, distribute, control, store measure or use electrical energy.
Therefore to meet the requirements of the "1989 Electricity at Work Regulations" it is widely regarded to be necessary to implement a programmed of planned inspection and testing of portable appliances.
Provision and Use of Work Equipment Regulations (PUWER)
Regulation 5(1)
- PUWER requires employers to ensure that work equipment is maintained in an efficient state, in effective working order and in good repair.
Provisions & Use of Work Equipment Regulations 1992
- Every employer shall ensure that work equipment is maintained in an efficient state, in efficient working order and in good repair.
Provisions & Use of Work Equipment Regulations 1998
- Every employer shall ensure that the result of an inspection made under this regulation is recorded and kept until the next inspection under this regulation is recorded.
